A More Productive Method For Resolving Your Family Dispute

Divorce and separation do not have to be a hard-fought battle of wills. At Vale Family Law & Mediation, we have observed that often the best agreements are those made when both sides have a voice. In mediation, both partners have the opportunity to discuss their viewpoints within a neutral setting, aided by a mediator who represents neither party. This more cooperative approach takes the pressure and stress out of the resolution process so that you can think clearly and come to a mutually acceptable agreement.

Putting Control Back In Your Hands

We know that those who can come to the table in the spirit of collaboration often get results that best meet their needs and achieve their goals. Why?

  • With mediation, you have much more control over the outcome because you make the final decisions. A judge must make decisions based on the facts presented in court. This often limited information can lead to outcomes where neither party is satisfied. However, mediation gives you the freedom to create agreements that work best for your family, who you know better than anyone else.
  • Mediation is often a more efficient, and thus cost-effective, process. You don’t need to wait for a court date or rearrange your schedule to appear in court. It is also very unlikely that your scheduled mediation will be cancelled, unlike a court date, which can frequently be rescheduled because of double-booking. Once you have reached an agreement, your agreement can be filed with the court and you can move forward under its terms. Reaching agreement sooner helps you to refocus your energy where it belongs — on moving forward — rather than on a stressful and costly court process.
  • A skilled mediator can help each of you move beyond the unproductive dialogue that wounded you during the relationship. A family law lawyer mediator can provide legal education, and a negotiation structure that can maximize your opportunities for settlement.
  • Mediation is a confidential negotiation process. This helps you to feel comfortable to explore different options, without the worry that the details of that conversation will later be presented to the court.
  • Mediation provides the opportunity to build your knowledge of family law, in a shared setting, thereby minimizing the misunderstandings and cross-talk.

Our Mediation Services

Lawyer Anouk Crawford has been mediating disputes since 2006 and is a registered family law mediator by the Law Society of British Columbia. This means she has completed extensive training in addition to her legal education on alternative dispute resolution as it applies to family matters. She also has a background in psychology, an asset that helps her facilitate productive discussions between people who are often in conflict when they begin mediation. She has extensive experience mediating complex situations and her mediation services have been requested from Vancouver to the Okanagan.

When serving as a mediator, Ms. Crawford maintains a neutral role in the discussions. If you wish to retain her as private counsel, you will need to find a third-party mediator to proceed with mediation.
